If you have been in an automobile accident in Michigan, you have valuable rights and benefits. These rights and benefits are available whether you were the driver or passenger of a motor vehicle or a pedestrian hit by a motor vehicle. It is critical, as a victim in an automobile accident, that you understand these rights and benefits. Under the Michigan No-Fault statute, your insurance company is responsible to pay certain personal protection insurance benefits, commonly referred to as no-fault benefits. As an automobile accident victim, you also have the right to pursue a tort liability claim against the at-fault driver to recover damages that are not compensated by your insurance company (i.e. pain and suffering, disfigurement, scarring). If you are awarded damages (money) through a trial or your case is settled, it is the at-fault driver’s insurance company that pays you the money damages.
